QOS and MPLS and Percentage-based policing

So today in the Frame-relay world where we have traffic shapers and hierarchical policies, each policy-map associated with a bandwidth value can be leveraged to use percentage-based policing.

For example, for a 256k circuit i can have a common policy:

policy-map parent-256

class class-default

shape average 256000

service-policy pol-256

And that can be used to say something like:

class DAY-EASTERN

police cir percent 25

Which works well and will police to 25% of the bandwidth of that site

How in the world can i do this with a common-host facility that is say a DS3 or OC3 when there is going to be no traffic shapers per site?

Any ideas?
