Is it a .bin file or is it a directory with the .bin file inside ? If you do a "dir flash" how many images are in flash?

Now that you point that out it is a dir. I changed to the dir and was able to delete the old file. I just completed the the new code upgrade. Thanks for the thought problem solved.
