High avalibilty help

Guys we have two routers 2821 which is connected to a layer three switch (which has many routes) now the swicth is nortel one which doesnt support ospf or eigrp......all we can do is static routing....now sattic routes are getting redistributed into BGP on cisco routers note both routers are going to one service provider....now if i config HSRP and track the ethernet links which goes to routers but even if the link get broken those static routes will still remian present in router one though the lan will shift the traffic to router 2.....so traffic will be again coming back from 1st router.....guys can someone please help how to do this

Time to replace the switch perhaps...

Or may be it supports RIPv2.
