Bug in IOS SMI Version for Cat3550

We have a cat3550 installed with SMI IOS version. Connected is a checkpoint firewall which is talking over vrrp multicast packets to a other checkpoint firewall. As long the ip routing with static routes is enabled, vrrp doesn't work. As soon we turn it off it does. We have found following bug on the Cisco Pages:

We were able to solve our problem with a upgrade to EMI version. Now is our question if we have to really pay for a upgrade or not? This is a bug from cisco which from my side should really be supported on the SMI IOS version correctly. How is a case like this handled normally? Thanks for your Feedback.

I think you don't have to pay in this case. I suggest you to check with your local Cisco accounts/sales person.
