Software download requires login vs Service Contract

I have noticed this with IOS versions for different hardware but I will give a specific example here.

The SE6 IP Services IOS for 3560 only requires me to log in with my CCO ID but the SE7 and SE8 version require me to have an active Service Contract in order to download them.

12.2.55-SE6(ED) vs 12.2.55-SE7(ED) or 12.2.55-SE8(ED)

So my question is at what point does Cisco make a specific version only require users to login rather then having an active service contract in order to download? - After it has been released for a certain amount of time? After a certain number of newer releases are out? If a major security hole has been fixed?
