no busy tone when dialing an engaged number (and no VM)

I have the following problem on a call manager 5.1.1 install:

when a user dials an engaged number it does not recieve a busy tone.

setup:

call manager 5.1.1

GW=2821 IOS: c2800nm-ipvoicek9-mz.124-10.bin

I do get the busy signal/disconnect coming into the gateway:

the strange thing is that when I add a new phone to the network it works, but when I log a user in (extension mobility) and log him out again, after that on the same phone, I get no busy signal anymore. It just dials and disconnects.

I have set the progress indicators on the appropriate dial-peers:

dial-peer voice 11 pots

description ** Mobile telephone dial-peer **

destination-pattern 004........

progress_ind setup enable 3<------------

progress_ind disconnect enable 8<-------

direct-inward-dial

port 0/0/0:15

forward-digits 10

anyone seen this before? does this have to do with network locale (set to Australia)??
