Can resellers sell old stock Cisco switches as new??

We just bought a new Cisco 2950 switch from a reseller we've never dealt w/ before.

The date on the packaging box is 2005-12-05, but the sticker on the bottom of the switch is dated back in year 2003!!

The IOS version is 12.1(22)EA4a, which is not too old but not the latest version either.

I talked to several folks on another forum and was told refurbished models have "RF" as part of the part#. Mine's ws-c2912-12 so it seems to be a legit new switch.

However, we're missing the usual mounting brackets, console cable, and documents.

I think they just flashed a newer version of IOS on an old stock switch.

(i assume it's considered new if it's never sold to anyone)

Can they do that??

This looks very suspicious to me...any comments??
