suppose we have a LAN with 2 layers: access layer & distribution/core layer.

access layer : 3550 (layer 2 IOS)

D/C: 6509 (layer 3 IOS)

the core layer is duplicated for security .

every 3550 switch is double connected to the 2 6506 via Giga Eth (MMF): one uplink for each 6506.

inspite of using HSRP between the 2 6509, can we use load balacing between the 2 6509? so that both 6509 will function in the same time sharing the trafic & if one 6509 will go down the second will assume all the trafic

This should not be a problem if you can use for example 2 VLANs at the access layer. Then you could use PVST and HSRP and Trunks to the access switches. And uplinkfast.
