Do I need a license for the Unity failover server ?

For current Unity 4.x versions you only need a license on the primary server that licenses you for failover. When the Failover Config program is run (on the primary and secondary), this license gets replicated to the secondary system.

Also if you were wondering is failure is something you need to buy the answer is yes. Failure is a pay feature.
