I'm running into the same issue on the newer ASAs. Not sure why the shaping command is missing or removed, but it needs to be available, especially for sub-rate ethernet connections.
What did Cisco have to say about this issue? I am having the same issue with one of my routers. Can't VPN to it and then route to a remote network on the other side of it, but forwarding to the locally-connect inside network works fine.
