QoS on POS OSM OC-12

I'm having some issues with configuring qos on a pos oc-12 osm blade. It appears that when using mqc, class maps matching dscp 46, protocol ospf and protocol bgp invoke nbar and software switch all the packets that are match. That being said control traffic can't get any CPU time, do to the software switching. Thoughts??

What you can do is shape the traffic out the pos interface so that you smooth out the bursts of traffic and the rate does not get over
